The compliance date for the HIPAA Security Rule is April 21,
2005.
Security refers to the prevention of having data and information
accessed by those without a “need to know”. The
security and integrity of electronic health data must be protected
from
unauthorized users. The HIPAA Security Rule
challenges that all electronic transmissions maintain a balance between being
accessible while also being secure and confidential.
The HIPAA Security Rule
applies to electronic protected health information (45CFR164.302). Certain
transmissions, paper, facsimile, and voice, via telephone,
are not considered to be transmissions
via electronic media because the information did not exist in electronic
form prior to the transmission (45CFR160.103(2))
